What is FSMA and who must comply with it?
The Food Safety Modernization Act (FSMA) is the most sweeping reform of US food safety law in 70 years, signed into law in 2011. Most facilities that manufacture, process, pack, or hold food for human consumption in the USA must comply with FSMA's Preventive Controls for Human Food rule (21 CFR Part 117), which requires documented Preventive Controls managed by a Qualified Individual (PCQI).
Does FSMA apply to Canadian food exporters to the USA?
Yes - if you are exporting food to the USA, you must comply with FSMA regulations. You may need to register your facility with FDA, comply with the Preventive Controls rule, and your US importer must comply with the Foreign Supplier Verification Program (FSVP) to verify your food safety systems.
What is a PCQI and does my facility need one?
A Preventive Controls Qualified Individual (PCQI) is a person who has successfully completed PCQI training (FSPCA training program) or is otherwise qualified to develop and oversee your Preventive Controls food safety plan. Most FSMA-covered facilities need at least one PCQI. Iyarkai's consultants are PCQI-trained.
What is the Foreign Supplier Verification Program (FSVP)?
FSVP requires US importers to verify that their foreign (non-US) food suppliers are producing food in accordance with processes and procedures that provide the same level of public health protection as required in the USA. Canadian exporters to US importers need to be aware of and cooperate with their US buyers' FSVP programs.
